ACKNOWLEDGEMENT AND ACCEPTANCE OF TERMS OF SERVICE

Dj-draven.com (DJ-Draven) is owned and operated by Global Elite, LLC and its respective owners. All on this site is provided to its viewers and members under these Terms Of Service (TOS), and any operating rules and/or policies that may be published by DJ-Draven. The TOS presents the full agreement between the members and DJ-Draven. The TOS supersedes all agreements between the parties regarding the subject material contained on DJ-Draven.

DESCRIPTION OF SERVICE

DJ-Draven provides itself as both a resource for the members and those that follow either the bands or DJ-Draven. All criteria listed within the respective join pages defines the basis of the agreement between DJ-Draven and the member. All options listed on the join pages will be given a time frame agreed upon by both DJ-Draven and the respective member. Criteria such as modifications and interviews will be kept to the criteria of the Join pages unless DJ-Draven gives notice 48 hours prior or the member fails to meet the agreed timeframe between DJ-Draven and the member.

PAYMENT

Payment stated at the period of joining is the set rate for the member to pay per month. This amount will not change during the tenure of the member unless their membership ends and is restarted where it may be subject to the current rates. All payments are final. Upon the termination of membership due to choice of DJ-Draven or the member all material within the profile provided by the member shall be removed within three days time. All material tied to "Band Of The Month" or interviews will remain unless specifically stated by member (if said items fall under the ownership of the member).

PRIVACY POLICY

The member's service is subject to DJ-Draven's Privacy Policy.

INDEMNITY

With membership you agree to indemnify and hold DJ-Draven and any directly affiliated with Global Elite (affiliates, officers, agents, co-branders, and any partnerships) harmless from any alleged claim or demand. This will include any possible attorney fees from the member or a third party related to membership, any related membership issue, termination of membership due to violation of the TOS, or any defamation of this site's brand.

ORIGINAL MATERIAL

All written, audio, or graphical material created by DJ-Draven is the sole ownership of the site. The member agrees that upon membership that the material created in the form of reviews, interviews, and original material created is the sole ownership of DJ-Draven. The member agrees to obtain consent of DJ-Draven in any consideration to distribute, sell, or alter said material in partial or its entirety.

MODIFICATIONS TO THE TERMS OF SERVICE

DJ-Draven reserves the right to modify or discontinue the service with or without the notice to the member. DJ-Draven shall not be liable to member or to any third party should DJ-Draven determine to terminate agreement with the member or to exercise the Terms Of Service to modify agreement with the member.

TERMINATION

The termination of membership may occur at the sole discretion of DJ-Draven if there is a violation of the Terms Of Service, Global Elite and/or DJ-Draven are presented in a means that is seen as either damaging to their respective brands or what they represent.

Upon termination the profile of the member will be reverted to its original state within 72 hours time. All material provided by the member will be removed from the site to ensure no violation in copyrights that non-membership  may create. Any interviews, Band of the Month, or Song of the Week entries will remain unaltered, unless requested by the member after termination.

SUSPENSION

In the event of a dispute of the member's identity or the rights to the material provided, the one presenting the dispute must provide documentation of ownership.  The profile will remain unaltered until the member may prove their ownership of provided material as well. All claims will be verified by DJ-Draven to ensure that the profile, the member, and the representation of both are preserved.

LINKS

Member may provide links to their own websites and any additional sites or resources. DJ-Draven has no means of directly ensuring the contents of said links and the member agrees upon membership in being the party responsible of said links. This includes the availability of said links, the contents of links, and any damage that may occur from people going to these links.

MEMBER CONTENT

The member agrees to grant DJ-Draven a grace period to review and post material provided by member. Any material deemed as sensitive, offensive, or adult in nature may be placed at the discretion of DJ-Draven. Such material will be discussed with member and may result in one or more of the following, at the member's approval: distortion of the original content, blackening of regions in question, or a warning placed on all links to said page and/or on the page itself. DJ-Draven  reserves the final right to deny the posting of said material.

DISCLAIMER OF WARRANTIES

You expressly understand and agree upon membership that:

(a) All material that is provided by you is your own material. Violation of this is will fall upon the member, not DJ-Draven. Any violation of this will result in immediate termination of membership.

(b) Despite the desires in promoting the music industry, DJ-Draven makes no warranty and/or promise to: (i) procure a record contract, (ii) to give anything except exposure and positive representation of the member

(c) All final material presented on DJ-Draven is presented in a fashion that best meets your standards and has both you, the member, and DJ-Draven's interest and representation in mind.

(d) No advice or information, written or oral, will supersede the TOS. Unless stated as a provision within the TOS.

(e) DJ-Draven will present the member in the best fashion possible. The member will also provide positive representation of DJ-Draven as well. Any deviation in this may result in termination of membership.

(f) All material presented on DJ-Draven has been approved by you, the member, and is truthful in its entirety.

LIMITATION OF LIABILITY

You expressly understand and agree that DJ-Draven shall not be liable for any direct or indirect damages including, but not limited to loss in profits, image, or possible other damages. As each item in question is approved by you, the member, you accept total responsibility to any possible outcome of what is presented on DJ-Draven. This also applies to any involvement from a third party in said damages.

VIOLATIONS TO TERMS OF SERVICE

To report any violations or abuse to the TOS, please send an e-mail to draven @ dj-draven.com. Please give detailed information and any references of the said violation that may be reviewed by DJ-Draven. To expedite the processing of your report, please put "VIOLATION: TOS" as the subject.

VIOLATIONS TO COPYRIGHT

If you have any suspicion of a violation of copyright by DJ-Draven or a member in the form of electronic, audio, graphical, and/written material; please contact this site by direct mail:
